Terms of Service
Article 1 (Purpose)
These Terms and Conditions set forth the rights, obligations, responsibilities, and procedures between Create Korea Co., Ltd. (the “Company”) and members regarding the use of products and related services provided through the DULWICH COLLEGE SEOUL Online Uniform Shop (the “Site”) operated by the Company.
Article 2 (Definitions)
1.“Site” refers to the online uniform shop operated by the Company for the sale of DULWICH COLLEGE SEOUL’s school uniform products (“Products”).
2.“Member” means a person who agrees to these Terms and Conditions, registers on the Site, and uses the services provided by the Company.
3.“ID” means a combination of letters and numbers set by the member and approved by the Company for identification and service use.
4.“Password” means a combination of letters and numbers set by the member to verify their identity and protect personal information.
Article 3 (Posting, Effectiveness, and Amendment of Terms)
1.These Terms and Conditions become effective upon being posted on the Site.
2.The Company may amend these Terms and Conditions to the extent that it does not violate relevant laws, and any amendments will be posted on the Site or notified separately.
3.If a member does not agree to the amended Terms and Conditions, they may discontinue use of the services and withdraw their membership; continued use will be deemed acceptance of the amended Terms and Conditions.
Article 4 (Formation of Service Agreement)
1.The service agreement is established when a member agrees to these Terms and Conditions, completes the membership registration, and the Company approves the application.
2.The Company may reject or terminate the service agreement in the following cases:
① If false information is provided
② If another person’s name or phone number is used
③ If the Company’s operational policies are violated
④ If the applicant did not receive the access link from DULWICH COLLEGE SEOUL or is not duly authorized
⑤ If the member violates these Terms and Conditions
⑥ If the member uses the Site fraudulently or interferes with the Company’s business
Article 5 (Membership Registration and Account Management)
1.Membership registration is conducted through mobile phone verification, and members set their own ID and password.
2.Members must promptly update any changes to their registered information on the Site; any disadvantages arising from failure to do so are the member’s responsibility.
Article 6 (Provision and Modification of Services)
1.The Company provides the following services:
① Online ordering of products
② Checking order history and delivery information
③ Processing withdrawal of subscription and exchange requests
④ Other additional services determined by the Company
2.The Company may change the content of services as necessary for operational or technical reasons and will notify members in advance.
3.In the event of product out-of-stock or changes in technical specifications, the Company may change the details of products to be provided under future contracts and will promptly notify members by specifying the changed product details and provision date where the current product details are posted.
Article 7 (Suspension of Services)
1.The Company may temporarily suspend service provision due to maintenance, replacement, breakdown of information and communication equipment, or interruption of communications.
2.The Company compensates members or third parties for damages caused by temporary suspension of services, except where the Company proves no intent or negligence.
Article 8 (Withdrawal and Loss of Membership, etc.)
Membership withdrawal is possible in the following cases:
1.Members may request withdrawal at any time, and the Company will process it immediately.
2.If the Company is closed, membership will be automatically terminated.
3.If false, omitted, or erroneous information is registered, the Company may process withdrawal.
Article 9 (Notices to Members)
1.The Company may notify Members via the phone number or email address registered by the Member.
2.For notices to an unspecified number of members, the Company may post on the Site’s bulletin board for at least one week in lieu of individual notice. However, matters that significantly affect a member’s transaction will be notified individually.
Article 10 (Order and Payment)
1.Members may order products by selecting them on the Site and making payment through available payment methods.
2.The Company supports the following payment methods, which may be added or changed:
① Naver Pay, Kakao Pay, Samsung Pay, Payco, SSGPAY
② Domestic credit cards
③ Overseas credit cards (Visa, MasterCard, JCB)
④ Bank transfer
⑤ Other methods designated by the Company
3.Upon receiving a member’s order, the Company sends an order confirmation notice, and the purchase contract is deemed concluded when the notice reaches the member.
Article 11 (Delivery)
1.Delivery is made to the address specified by the member, and delivery fees and periods are separately indicated on the product order page.
2.If delivery is delayed without just cause, the Company will promptly notify the member and take appropriate measures.
Article 12 (Refunds)
If the Company cannot deliver or provide the ordered product due to out-of-stock or other reasons, it will promptly notify the member and, if payment has already been received, refund within three business days or take necessary steps for refund. If it is difficult to notify the member for reasons not attributable to the Company, the refund period may exceed three business days.
Article 13 (Withdrawal of Subscription and Contract Cancellation)
1.Members may withdraw from or cancel the purchase contract within seven days of receiving the product. However, if otherwise provided by the Act on Consumer Protection in Electronic Commerce, etc., such provisions shall prevail.
2.Members may not withdraw or cancel in the following cases:
① If the product is lost or damaged due to reasons attributable to the member (except for damage to packaging required to check the contents)
② If the value of the product has significantly decreased due to use or partial consumption (e.g., worn items)
③ If the value of the product has significantly decreased due to the passage of time, making resale difficult
④ If the Company has notified in advance of restrictions on return/exchange for specific products
3.Notwithstanding Paragraphs 1 and 2, if the product differs from its labeling/advertising or the contract, the member may withdraw or cancel within three months of receiving the product or within 30 days of discovering or being able to discover the discrepancy.
4.Exchanges and returns are processed as follows:
① ‘Exchange/Return Request’ on the Site
② Enter reason and details
③ After approval, send the product by courier
④ Refund or reshipment after warehouse receipt confirmation
5.During the exchange/return process, additional information such as collection address and tracking number may be collected.
Article 14 (Effects of Withdrawal of Subscription, etc.)
1.Upon receipt of returned products from the member, the Company will refund the payment within three business days. If the Company delays the refund, it will pay delay interest as prescribed by the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.
2.If payment was made by credit card or electronic currency, the Company will promptly request the relevant provider to suspend or cancel the charge.
3.The member bears the cost of returning the product in case of withdrawal of subscription, etc. The Company will not claim penalties or damages for such withdrawal. However, if the withdrawal is due to the product differing from its labeling/advertising or the contract, the Company bears the return cost.
Article 15 (Obligations of Members)
Members must not:
1.Use another person’s personal information
2.Register false information
3.Interfere with the normal operation of the Site
4.Violate relevant laws or these Terms and Conditions
5.Register as a member or purchase products without having received the access link from DULWICH COLLEGE SEOUL or without proper authorization
6.Allow third parties to use their ID or password
Article 16 (Obligations of the Company)
1.The Company shall not engage in acts prohibited by law or contrary to public order and morals, and shall endeavor to provide goods and services continuously and stably as stipulated in these Terms and Conditions.
2.The Company shall establish a security system to protect members’ personal information (including credit information) for safe internet service use.
3.If the Company causes damage to a member through unfair labeling or advertising under the Act on Fair Labeling and Advertising, it shall be liable for compensation.
4.The Company will not send unsolicited commercial emails for profit purposes to members.
Article 17 (Restriction and Termination of Service Use)
1.If a member violates these Terms and Conditions, the Company may take measures such as warnings, temporary suspension, restriction, or termination of the service agreement.
2.In the following cases, the Company may restrict, suspend, or revoke membership without prior notice:
① Registration of false information during membership
② Intentional interference with Site operation
③ Violation of relevant laws or these Terms and Conditions
④ Unjust use of the Site or infringement of the Company’s legitimate interests
⑤ Members may request withdrawal at any time via the Site, and the Company will process it immediately.
Article 18 (Intellectual Property Rights)
1.All content (text, designs, images, etc.) on the Site and related intellectual property rights belong to the Company or legitimate rights holders.
2.Members may not reproduce, transmit, or distribute such content without the Company’s prior consent.
Article 19 (Protection and Processing of Personal Information)
1.The Company complies with laws related to personal information protection and strives to protect members’ personal information.
2.Matters relating to the collection, use, and provision of personal information to third parties are governed by the separately posted Privacy Policy.
Article 20 (Suspension and Termination of Services)
1.The Company may temporarily suspend service provision in the following cases:
① Inspection, maintenance, or replacement of information and communication equipment
② Unavoidable operational reasons such as communication failures or system errors
③ Force majeure events such as natural disasters
2.If damages occur to members or third parties due to such suspension, the Company is liable only in cases of intentional or gross negligence.
3.If the Company terminates services due to business transfer, business conversion, discontinuation, or other management reasons, it will notify members in advance as prescribed in Article 16.
Article 21 (Dispute Resolution and Jurisdiction)
1.The Company and Members shall faithfully consult to resolve disputes arising from service use.
2.If consultation is not possible, lawsuits regarding e-commerce disputes between the Company and Members shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
